These Terms of Service ("Terms") govern your access to and use of ClaimProof's website, assessment tools, and related services. By using our service, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By accessing or using ClaimProof at https://claimproof-e85e.polsia.app, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

ClaimProof provides an independent cyber insurance alignment assessment. Users complete a structured questionnaire and receive a scored report identifying gaps between their current cybersecurity posture and common 2026 cyber insurance requirements. The service also includes an optional policy document upload feature for gap analysis.

3. Eligibility

You must be at least 18 years of age to use this service. You represent that all information you provide is accurate and that you are authorized to provide any company or organizational data you submit.

4. User Accounts and Information

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Assessment Content and Scoring

The ClaimProof assessment is based on our proprietary scoring methodology, which evaluates alignment against common requirements found in 2026 cyber insurance policies. Scoring results are informational only. ClaimProof does not guarantee that any specific insurance policy will cover any particular loss or event.

6. Policy Document Upload

When you upload a cyber insurance policy document, it is processed in memory only and is not stored on our servers or in our database. We do not retain, copy, or archive policy documents after processing. You represent that you have the right to submit the document for analysis and that doing so does not violate any confidentiality obligation.

7. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any system, account, or data.
• Reverse-engineer, decompile, or disassemble any part of the service.
• Submit false, misleading, or fraudulent information through the assessment.
• Interfere with or disrupt the integrity or performance of the service.
• Use automated tools, bots, or scrapers to access the service without authorization.

8. Intellectual Property

All content, features, scoring methodology, and software on ClaimProof are the intellectual property of ClaimProof unless otherwise noted. You retain ownership of the information you submit. By submitting content, you grant ClaimProof a non-exclusive, royalty-free license to use it for the purpose of providing and improving our service.

9. Third-Party Services

Our service may integrate with or reference third-party products, services, or insurance carriers. ClaimProof does not endorse, guarantee, or accept responsibility for third-party products or services. Third-party providers' terms and privacy policies govern their own offerings.

10. Service Availability

We aim to keep the service available, but we do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, ClaimProof and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or goodwill, arising out of or related to your use of the service — regardless of whether such damages were foreseeable or whether any party was advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless ClaimProof, its operators, and affiliated parties from any claim, loss, damage, or expense (including reasonable legal fees) arising from your violation of these Terms or your misuse of the service.

13. Modifications to Terms

We may update these Terms at any time. The effective date at the top of this page will reflect the most recent revision. Material changes will be communicated by posting the updated Terms on this page. Your continued use of the service after changes are posted constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the service ceases immediately. Sections that by their nature should survive termination (Limitation of Liability, Indemnification, Intellectual Property, and this Termination clause) will survive.

15. Governing Law

These Terms are governed by the laws of the United States. Any dispute arising from these Terms or your use of the service shall be resolved in the courts of the United States.
